Facts
Plaintiffs/respondent brought an action for declaration of title to land trespass and injunction. During trial, plaintiff tendered purchase receipts and a plan of the land in dispute.
The claim was later amended (see page 83) to read as followsDefendants/appellants claimed that their families were the owners of the land from time immemorial.
Respondents appealed to the Court of Appeal which overturned the learned trial Judge's finding of fact and allowed the appeal.
A further appeal to the Supreme Court was made.
